FALLEN TREE ACT 🌴

It used to be a fallen tree was an act of nature. Well, it’s actually still an act of nature but a new bill is in the works to change the liability from mother nature to property owner. Florida lawmakers submitted a new bill last week, HB 599, which will hold property owners accountable for damages from a fallen tree onto neighboring properties. If passed the law could be Effective: July 1, 2025.

HB 599 Property Owner Liability: Provides that property owner is liable for damages caused by trees or shrubs located on his or her property when they fall on another's property; provides applicability; provides that trees & shrubs located on two or more parcels may be removed by any of property owners after serving proper notice & posting on other parcels; provides exception.
